Legal Scholars Demand Withdrawal of US Support for Attacks on Gaza<\/strong><\/p>\n\n\n\n

Dear President Biden,<\/p>\n\n\n\n

On October 7, Hamas committed deliberate atrocities against Israeli civilians. We join other Americans in condemning Hamas\u2019s killing and kidnapping of unarmed families and children, and we call for the immediate release of those still being held hostage. So too we condemn the Israeli government\u2019s escalating response, which is killing and displacing unarmed families and children in Gaza with the apparent support of the United States government. We therefore call for President Biden to seek an immediate cease-fire.<\/p>\n\n\n\n

The rising death toll among civilians in Gaza is a consequence not only of a direct military onslaught, but also the Israeli government\u2019s deprivation of the basic means of survival for the population as a whole. As of this writing, 2.3 million people are down to a trickle<\/a> of potable water. The United Nations Office for the Coordination of Humanitarian Affairs has observed<\/a> that Gazans \u201chave resorted to consuming brackish water extracted from agricultural wells\u201d because wastewater treatment sources have been cut off from electricity and fuel. It has also expressed \u201cdeepening concerns about dehydration and the outbreak of waterborne diseases, including cholera.\u201d Yet a blackout imposed by Israel is impeding the provision of medical care and disrupting the food supply. The International Committee of the Red Cross reports<\/a> that \u201cwithout electricity, hospitals in Gaza risk turning into morgues.\u201d Combined with Israel\u2019s barring the entry of food into Gaza, the blackout has imperiled<\/a> food security by disrupting the refrigeration and irrigation of crops, with wheat flour reserves expected to be depleted this week. Experts have warned<\/a> of starvation conditions amounting to war crimes. And for many Gazans, there is no escape. The bombardment has already destroyed<\/a> roads and infrastructure across Gaza. Under these circumstances, nearly one million people have already been displaced<\/a>, with almost half of the overall population being children<\/a> under the age of eighteen. The imposition of a communications blackout has further deprived residents of Gaza of the ability to coordinate with and reach their families. <\/p>\n\n\n\n

We fear that this humanitarian crisis is poised to get significantly worse as the Israeli government prepares an expected ground invasion of northern Gaza, killing and forcibly relocating even more Palestinian people. Israeli officials have ordered<\/a> that there be \u201cno electricity, no food, no fuel\u201d in Gaza because Israel is \u201cfighting human animals\u201d and is \u201cacting accordingly.\u201d The Israeli President, meanwhile, stated<\/a>, \u201cIt\u2019s an entire nation out there that is responsible,\u201d insisting \u201cthis rhetoric about civilians not aware, not involved, it\u2019s absolutely not true,\u201d and that Gazans \u201ccould have risen up, they could have fought against, that evil regime which took over Gaza in a coup d\u2019etat.\u201d Although Israeli officials claim<\/a> that civilians in Gaza can avoid further harm if they \u201cleave immediately,\u201d the International Committee of the Red Cross warns<\/a> that \u201cthe instructions issued by the Israeli authorities for the population of Gaza City to immediately leave their homes, coupled with the complete siege explicitly denying them food, water, and electricity, are not compatible with international humanitarian law.\u201d<\/p>\n\n\n\n

Collective punishment of two million civilians, nearly half of them children, is a moral catastrophe to which current U.S. policy critically contributes. We ask that President Biden act immediately, using all the means at his disposal to bring about a diplomatic solution to the present crisis. This means a cease-fire in Gaza and throughout the occupied territories, along with the unconditional restoration of food, water, electricity, and medical care to the entire Gaza Strip. It means a guarantee for Gazans to return to their homes. And it also means doing everything within our nation\u2019s power to promote a safe return of all hostages.<\/p>\n\n\n\n

A great and ongoing human tragedy was perpetrated upon Israeli civilians on October 7. We write this letter out of a conviction that a consequence of that awful day need not be further tragedy now carried out with our government\u2019s support.<\/p>\n\n\n\n
